Terms and conditions of membership purchases with NCyoga 

 

These terms and conditions apply to services provided by NCyoga, 9 Birkheads Road, Reigate, Surrey, RH20AR. You may contact NCyoga at Nancy.campbell@mac.com

 

These terms and conditions apply to my zoom classes, membership payments and all other services on my website. 

Please read them before purchasing. 

By clicking the ACCEPT button you agree to these terms and conditions which will bind you. If you do not agree to these term and conditions please do not proceed with the payment. 

 

1: Definitions

Confidential information means information provided by one party to the other in written, graphic, recorded, machine readable or other form concerning the business, clients , suppliers , finances and other areas of the other party’s business or products including without limitation, the course materials, but does not include information in the public domain other than through the default of the party disclosing the information, information required to be disclosed by any court or regulatory authority, or any information already the possession or control of the disclosing party. Course materials means the information provided by NCyoga as part of the services in hard copy or electronic form. Fees means the fees paid by you to Nancy Campbell for the service. Intellectual property rights means copyright rights in or relating to databases, patent rights, performers rights, designs and registered designs trademarks, rights in or relating to Confidential information and other intellectual property rights (registered or unregistered) throughout the world. Online Course means delivery of an online course pursuant to which you will learn remotely. Services means the provision of the online course and materials together with such other services as agreed from time to time to purchase individually. 

 

2: The Services

A description of the services together with the dates on which the services will begin are available and out lined on my website when purchasing. We will provide the services with reasonable care and skill in accordance to what is set out on the website. 

We reserve the right to vary or withdraw the services on the website without notice.

We expect you to confirm the services you are purchasing will meet your needs. We do not make any guarantee to you that you will obtain any particular result, professional qualification or employment opportunity from your purchase and completion. 

 

3:  Purchasing NCyoga services via the website 

3.1 In order to purchase any of the services online you must register for an account via the website. 

3.2 When you place your order for services with NCyoga via the website you are offering to purchase the service on these terms and conditions and Nancy Campbell reserves the right to cancel or decline your order or any part of the order at any time until it has been confirmed in terms of clause 3.4 below. 

3.3 Following receipt by us of your order for the service via the website we will contact you confirming receipt of your order 

3.4 A legally binding agreement between us and you shall come into existence when we have: accepted your offer to purchase the NCyoga service from us by sending you and email confirming the purchase and received payment. 

3.5 If you are on a promotional free trial you will be required to give your payment details in order to continue with the service at the end of the free trial period. 

 

4 Cancellation and Variation 

Subject to clause 4.2 below where we have accepted/ confirmed the service being purchased by you and formed a legally binding agreement with you, then you will be permitted to cancel your purchase of service. 

Workshops and Zoom classes are non-refundable after purchase unless an alternative agreement has been made. 

Memberships are able to be cancelled at any point but payments made are non-refundable and your access will last until the end the period for which you have paid. IF you want to cancel please contact me before the next monthly payment is due. 

 

5 Fees 

5.1 The fees for each service shall be as set out on the website at the time you placed an order for them 

5.2 unless otherwise specified at the time you purchase the service fees are inclusive of VAT and other local taxes 

5.3 the monthly fee for the service selected by you on the website shall be debited from your card or PayPal account at the time of purchase your membership shall run from the date of purchase until the same date the following month 

Any fees charged by your debit or credit card service are for your own account and NC yoga shall not be responsible for these 

5.5 you shall be responsible for all costs you incurred in connection with your access onto any membership services 

 

6: Liability 

6.1 no part of the provision of service shall be deemed to be, nor is intended to be, nor should it be taken to be, the profession of health advice 

6.2 NCYoga  aims to provide services to the highest standards… neither it nor its practitioners accept a) any inaccuracy or misleading information provided in the programmes or other services or any reliance by client on any such information b) any loss or corruption of data c) any loss of profit revenue or goodwill d) any indirect special or consequential loss arising from any breach of the terms of this agreement e) any illness or injury occurred while taking part in membership videos or online classes

6.3 In connection with these terms and conditions and the delivery of service and whether the liability arises because of breach-of-contract negligence or for any other reason shall be limited to the fees received by us in connection with the right reasons 

 

6.4 Nothing in this agreement shall exclude or limit NCYoga's liability for a) death or personal injury caused by negligence b) fraudulent misrepresentation c) any other matter which under English law may not be limited or excluded 6.5 no claim may be bought more than six months after the last date on which the service concerned has finished or ceased to be provided by NCyoga

 

7 :7.1 Intellectual property all intellectual property rights in the course and membership rpogramme remain the intellectual property right of NCyoga
7.2 You are not authorised to a): copy, modify, reproduce, re publish, sublicense, sell, upload, post, transmit, broadcast or dispute any of the course materials without prior written permission. b) record a video or audio tape really by videophone or other means the services given  c)modify. emerge or adapt any software forming from the services provided. D) breach of this clause will mean that we will immediately terminate your terms and conditions 

 

8 Confidentiality 

8.1Each party shall keep the other parties information strictly confidential and not use it otherwise them for purpose of these terms and conditions and shall return it on demand.

8.2 Either party may disclose confidential information to its legal and other advisors for purposes of obtaining advice 

8.3 this clause shall continue notwithstanding termination on these terms and conditions

 

9 Termination 

9.1 we shall be entitled to terminate these terms and conditions and provide you with any service with immediate effect and event you fail to pay your fees or breach this terms and conditions 

 

10 Assignment 

Any service provided by us under these terms and conditions are personal to you and cannot be transferred or assigned to another person 

 

11 Physical Exercise 

11.1 Physical exercise in all of its forms and with or without the use of equipment such as yoga mat blocks straps or any other equipment that may be suggested by and see yoga is a strenuous physical activity accordingly you are urged and advised to seek the advice of a physician before beginning any physical exercise regime routine program or using any suggested equipment shown in any of the video clips on the website and see Yoga is not a medical organisation and cannot give you medical advice or diagnosis or suggestions and comments relating to the use of equipment exercises and instructions are not required to be performed by you and carried out at your election while viewing NC yoga membership videos or live classes

11.2 nothing contained in the website should be construed as any form of such medical advice or diagnosis 

11.3 by using the website you represent that you understand that physical exercise involves strenuous physical movement and that activity carries the risk of injury whether physical or mental. 

11.4You understand that it is your responsibility to judge your physical and mental capabilities for such activities. It is your responsibility to ensure that by participating in class and activities from NC yoghurt membership if any such suggested adjustment or equipment is appropriate for your level of ability and physical and mental condition

11.5 you expressly ways and release any claim that you have at any time for injury of any kind against

    

12: Entire Agreement 

these terms and conditions are the entire agreement between the parties and supersedes any prior agreements and arrangements with the written or oral. You confirm that you have not relied on any representations in entering into these and any other terms and conditions with us nothing in this clause or terms and conditions to limit liability for any fraudulent misrepresentation. 

 

13: Data Protection

When you register with us you will need to provide certain data such as your contact details and demographic information we will store this data and use it to contact you provide you with details of the service you have purchased and otherwise as required during the normal provision of the course

 We will not pass any details of data on to anyone outside NCYoga
